Terms of Service

These Terms of Service ("Terms") govern your access to and use of Custodia (the "Service"), provided by the CROS family. By creating an account or otherwise using the Service, you agree to these Terms.

1. Your account

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

2. Acceptable use

You agree to use the Service in accordance with our Acceptable Use Policy. We may suspend or terminate accounts that violate it.

3. Your data

You retain all rights to the data you upload, including site geometries, observations, monitoring records, and field notes. We act as a data processor on your behalf — see our Data Processing Addendum.

4. Subscriptions and billing

Paid plans are billed in advance on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are issued at our discretion for service failures.

5. Service availability

We aim for high availability but do not guarantee uninterrupted service. Scheduled maintenance and emergencies may cause downtime. Critical incidents are reported through our status channel.

6. Intellectual property

The Service, including its design, code, and brand, is the property of the CROS family. You may not copy, resell, or reverse-engineer the Service without written permission.

7. Disclaimers and liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, our liability is limited to the fees you paid in the 12 months preceding the claim.

8. Termination

You may delete your account at any time. We may suspend or terminate accounts for material breach of these Terms or applicable law. Upon termination, you may export your data for 30 days.

9. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 30 days before they take effect.

10. Governing law

These Terms are governed by the laws of the United States. Disputes will be resolved in the courts of competent jurisdiction in our principal place of business.
